1. Acceptance of Terms
By accessing or using services from Brains Technologies Bangladesh (“BrainsBD,” “we,” “us”) via www.brainsbd.org, you agree to comply with these Terms and Conditions (“Terms”). If you disagree, refrain from using our services.
2. Services Provided
BrainsBD offers:
- Website design & development
- Domain registration & hosting
- Technical support & maintenance
- IT consulting (collectively, “Services”).
3. Client Responsibilities
You agree to:
- Provide accurate information during onboarding.
- Maintain backups of your data.
- Secure login credentials (we are not liable for unauthorized access).
4. Payment Terms
4.1 Fees
- Prices are in BDT (Bangladesh Taka) unless stated otherwise.
- Recurring services (e.g., hosting) auto-renew unless canceled.
4.2 Methods
We accept:
- bKash/Nagad (৳)
- Bank transfers (NPSB)
- Credit cards (3.5% processing fee).
4.3 Late Payments
- Overdue invoices incur 1.5% monthly interest.
- Services may be suspended after 15 days of non-payment.
5. Refund & Cancellation
5.1 Refunds
- Domain registrations: Non-refundable (per BTRC policy).
- Web design: 30% cancellation fee if work has commenced.
- Hosting: Non-refundable
5.2 Termination
Either party may terminate with 30 days’ written notice.
6. Intellectual Property
- All deliverables (code, designs) remain our property until full payment.
- Clients grant BrainsBD the right to showcase projects in our portfolio.
7. Data Protection & Privacy
- We comply with the Digital Security Act 2018 of Bangladesh.
- Client data is stored securely, but not responsible for third-party breaches.
8. Liability Limitations
- BrainsBD is not liable for:
- Indirect damages (e.g., lost profits).
- Downtime due to BDIX outages or force majeure
- Maximum liability = 100% of fees paid.
9. Dispute Resolution
- Negotiation: Parties must attempt an amicable resolution.
- Governing Law: Bangladesh courts have jurisdiction.
10. Amendments
- Terms may be updated; changes are effective upon posting to www.brainsbd.org.
- Continued use constitutes acceptance.
